A federal jury for the US District Court for the District of New Hampshire has awarded Marine Polymer Technologies $29.4 million in a patent infringement suit against HemCon Medical Technologies.
The suit concerned compounds used in hemostatic bandages used to prevent severe blood loss. HemCon sold the allegedly infringing products to the military since 2003, but in the last two years began selling to the civilian market. These sales caught the attention of Marine Polymer, who was also selling in that market, making the companies direct competitors.
The suit was filed on March 17, 2006 and was not settled until May 5, 2010. In a summary judgment motion last year, the Court found that HemCon infringed on Marine Polymer’s patent claims. The jury decided the remaining two issues: the validity of the patent claims, and the amount of damages HemCon should pay Marine Polymer for the infringement.
