On May 4, 2010, Marine Polymer Technologies, Inc. announced it was awarded $29.4 million in damages in its patent infringement lawsuit against HemCon, Inc. Filed in 2006, the infringement lawsuit related to biocompatible polymers that Marine Polymer uses in hemostatic products used to prevent severe blood loss.
After prevailing on a summary judgment motion for infringement in 2009, the jury was presented only with the issue of damages and patent validity. Ultimately, the jury found the claims were valid, and awarded Marine Polymer $29.4 million.
Marine Polymer will seek a permanent injunction and accounting of HemCon’s 2010 sales of the infringing product, which were not included in the jury’s verdict.
